Saiful’s Method Of Swearing On Quran Against Islamic Teachings, Says Nik Aziz
The method of swearing on the Quran used by Mohd Saiful Bukhari Azlan who has alleged that Parti Keadilan Advisor Datuk Seri Anwar Ibrahim sodomised him, is against the teachings of Islam, said PAS spiritual leader Datuk Nik Abdul Aziz Nik Mat.
Nik Aziz said the holding of a Quran to declare one was telling the truth was more an imitation of the Christian practice of swearing on the Bible.
“In Islam, anyone is free to declare that he or she is telling the truth in a matter, but not by holding the Quran as it is copying the practice of Christians,” he told reporters after accompanying the Pakatan Rakyat delegation during the nomination process for the Permatang Pauh by-election here today. Anwar is the Pakatan Rakyat candidate for the by-election, which will be held on Aug 26.
The Kelantan Menteri Besar, however, said the “sumpah laknat’ (swearing in the face of divine retribution) that was done by Saiful when he swore on the Quran was permitted by Islam and now it depended on the sincerity of his oath that he had been sodomised by Anwar.
On calls for Anwar to do likewise to proclaim his innocence, Nik Aziz said in Islam the one making the accusation should do it to declare he or she is telling the truth and later the accused must defend him or herself.
Can somebody tell me the implications regarding this whole business of swearing on the Quran? Does it have any legal (civil or Syariah) ramifications?

It has no legal ramifications whatsoever, available evidence is more relevant, under syariah law the accuser must produce 4 witnesses.
muhabalah is usually between husband and wife , I am told.
if there no witnesses , the accuser swears 5 times , one for himself and 4 times for the requisite witnesses.
the accused also swears 5 times.
the IF there is no further evidence , the matter is between them both and god.
since Anwar has already given tetimony to the syariah court , what saiful has done is tantamount to contempt of the syariah court.
needless to say , his timing is also in bad taste.
his initial report is of non-consensual sex, the court charged Anwar undet a section which pertains to consensual sex, and after that he swears that it was nonconsensual.
It was also bad taste for TV3 and Bernama to replay the CONfession over and over again.
I was talking to a group of senior citizens on saturday, thay dont go online and depend on MSM for their news, even those who had doubt as to Anwars guilt now are convinced that it is a political conspiracy, and these are the kiasu senior citizens who voted BN on march 8th.
I dare say if nationwide snap polls are called -now-BN will be ousted.

To be honest, does one, even the ancillary or sexologist ever wonder that a man’s penis

I have not the slightest doubt that Saiful’s swearing on the Koran constitutes contempt of court and that it is a blatant attempt at trial by media and perversion of the course of justice.
(If and )When the civil court trial gets underway, Saiful will have to testify and in order to do that he WILL have to swear on the Koran. He knows it, his lawyers know it and the police know it. The whole world knows it!
So, why did Saiful pre-empt proceedings by swearing in public so conveniently on the eve of nomination day at Permatang Pauh? More so since DSAI had already filed a case against him in the Syariah Court!!
Obviously to politicise his case and also to influence voters and public opinion. Can there be conduct more scurillous than this?
I call upon the Chief Justice of Malaysia to intervene and dismiss the charges and case against DSAI in view of this gross contempt of court. The presence of the police and Saiful’s lawyers at this pathetic behaviour lends further credence to public perception that a mockery has been made of the due process of our Judicial System.
This misbehaviour may well have set a dangerous precedence and grounds for a spate of thieves, robbers, rapists and muderers to misuse religion to sway public opinion and evade the clutches of our Civil Courts.
It is incumbent on the part of our CJ, Minister of Law, PM, Parliament and The Agung to nip things in the bud, post haste!!
